Apple sued over Siri false advertising

Siri has both its fans and its detractors, but one such detractor, Frank Fazio, felt that Siri was marketed in such a way that it could be construed as false advertising, so much so that he has decided to file a lawsuit against Apple, alleging that Apple’s ads are misleading when it comes to promoting Siri’s capabilities. According to the suit:

“Through an extensive and comprehensive nationwide marketing campaign, Defendant has conveyed the misleading and deceptive message that the iPhone 4S’s Siri feature, a so-called voice-activated assistant, performs useful functions and otherwise works as advertised.

“For example, in many of Apple’s television advertisements, individuals are shown using Siri to make appointments, find restaurants, and even learn the guitar chords to classic rock songs or how to tie a tie. In the commercials, all of these tasks are done with ease with the assistance of the iPhone 4S’s Siri feature, a represented functionality contrary to the actual operating results and performance of Siri.”

Fazio claims that when he attempted similar commands with Siri, not only did it take a long time for Siri to respond, but it responded with the wrong answer. The suit also goes on to claim that continuous usage of Siri would lead to a surge in data usage which could go over the subscriber’s data plan. However it should be noted that Siri is considered to be in beta, although that notice is apparently “buried in Apple’s website”.

No word from Apple just yet, but what do you guys think? Does Siri work for you like it does in the ads, or do you think that it’s a complete waste of time?
